CampusAuction Privacy Policy

This Privacy Policy (the “Privacy Policy”) is part of the Terms of Use User Agreement (the “Agreement”), and capitalized words in this Policy have the same meanings as defined in the Agreement, unless provided otherwise.  “We,” “Us,” and “Our” refer to CampusAuction Ltd. (the “Site Provider”).  “You” and “Your” refer to you, the user.

The Site Provider has created this Privacy Policy in order to provide users of CampusAuction sites and services with a clear understanding of how the Site Provider operates CampusAuction and handles Your personal information, as well to demonstrate the Site Provider’s firm commitment to privacy. The following discloses the information gathering and dissemination practices for CampusAuction including the types of personal information We gather when You use Our services, as well as some of the steps We take to safeguard it.

If You have questions about Our Privacy Policy, if You feel that We are not abiding by the terms of this Privacy Policy, or if You have requests or corrections regarding Your personal information, please contact Customer Support: admin@campusauction.com. The Site Provider may modify this Privacy Policy at any time with proper notice as provided in the Agreement.

Governing Law

In addition to the governing law provisions in the Agreement, and because privacy law varies from jurisdiction to jurisdiction, the Site Provider clarifies governing law with respect to this policy as follows:

If You are in Canada, this Privacy Policy conforms to and is subject to the Personal Information Protection and Electronic Documents Act (Canada) and/or the Personal Information Protection Act (British Columbia) as applicable.

If you are not in Canada, this Privacy Policy has been created to conform to the relevant Canadian privacy laws, and therefore conforms to the Model Code for the Protection of Personal Information (CAN/CSA-Q830-96).

If you are in the United States, or if you are in another country but using the United States CampusAuction website, it is possible, though highly unlikely, that this Privacy Policy may be superseded by the Uniting (and) Strengthening America (by)Providing Appropriate Tools Required (to) Intercept (and) Obstruct Terrorism Act (United States), also known as the USA PATRIOT Act (United States).

Information Collection and Use

When You visit and navigate CampusAuction, the Site Provider will not collect any personal information about You unless You provide us that information voluntarily. Personal information includes Your name, address, e-mail address, telephone number and/or credit card. The Site Provider collects information from users at several different points on CampusAuction and it is the only entity privy to the information collected on CampusAuction, except as provided in this Privacy Policy or as required by law. The Site Provider does not sell, share, or rent this information to others in ways different from what is disclosed in this Privacy Policy.

Registration and Order Forms

In order to use some of the CampusAuction services, users must register by first completing the New User registration form. This registration form requires users to supply their contact information (i.e. name and address) and financial information (i.e. credit card number). We use this customer contact information to send information to our registered users about the services for which they have subscribed. We use the financial information collected to verify the user’s identity and to bill the user for products and services.

Cookies

A cookie is a piece of data stored on the user’s hard drive containing information about the user. CampusAuction uses cookies to save users’ passwords so that they don’t have to re-enter it each time they visit CampusAuction. Cookies on our site are in no way linked to any personally identifiable information.  The Site Provider does not use any third party tracking cookies on CampusAuction.

Log Files

We use Your IP (Internet Protocol) address for the following purposes:

  1. to help diagnose problems with our server;
  2. to administer our website;
  3. to analyze trends and demographics in the aggregate; and
  4. occasionally for security purposes.

We may use IP addresses to discover and prevent unauthorized use.  If You believe Your IP address has been blocked through no fault of Your own, please contact Us at admin@campusauction.com.

When We use IP address information for security, functionality, or other administrative purposes, We keep these uses and the analysis of this information separate from aggregate trend analysis uses, and We take reasonable steps to protect Your information from misuse.

When we collect IP addresses for aggregate trend and demographic information analysis, we do not match the IP addresses to personally identifiable information.

Data Sharing

The Site Provider does not give out registered user address or credit card information except where:

  1. We have your consent;
  2. We provide such information to trusted businesses or persons for the sole purpose of processing personally identifiable information on Our behalf;
  3. We have reason to report to a credit reporting agency pursuant to the Agreement;
  4. We need to deliver a product or service that You have ordered; or
  5. We are complying with valid legal process.

We do not sell or rent Your personal information to 3rd parties.

We may occasionally share aggregated non-personally identifiable user demographic information, such as anonymous usage data, referring URLs, number of clicks, etc., with Our Corporate Partners and advertisers.  This information is not linked to any personal information that can identify an individual person.

We use an outside shipping company to ship orders, and a credit card processing company to bill users for goods and services. To our knowledge, these companies do not retain, share, store or use personally identifiable information for any secondary purposes.

Our servers are located in Canada; however the companies whose services We use for shipping, credit card processing, etc., may maintain facilities in Canada, the United States, or other countries. By using CampusAuction, You consent to the transfer of Your personal information among these facilities, including those located outside Your country.

In the event of a transfer of majority ownership of the Site Provider, such as acquisition by or merger with another company, We will provide notice before any personally identifying information is transferred and becomes subject to a different privacy policy.

Links to Other Websites

CampusAuction site contains links to other sites. The Site Provider is not responsible for the privacy practices or the content of websites that link to or from CampusAuction.

Security

The Site Provider has equipped CampusAuction with security measures to prevent the loss, misuse and alteration of the information under Our control. We take every reasonable precaution to protect Our users’ information. We protect the submission by electronic form of sensitive information (such as credit card numbers) with industry-standard security technology, such as secure socket layer (SSL) encryption.  The technology used may change without notice as new or improved security measures become available.

The Site Provider also security measures to protect Your information while it’s in our care, including security technology on our servers and appropriate corporate policies regarding employee handling of sensitive information.

Only authorized employees who need the information to perform a specific job that is appropriately related to the purposes for which We collected Your information are granted access to personally identifiable information.

Correspondence with Users

When You register as a user of CampusAuction, You agree to receive correspondence from the Site Provider, which correspondence may include confirmation of user information at registration and subsequently when You update Your information, confirmation and other information related to Your bids and orders, regular e-mail newsletters from the Site Provider letting You know about upcoming auctions and other related marketing information, and other correspondence and communication from the Site Provider from time to time.

Updating Personal Information

To update or correct Your information, please do so using the tools provided online through CampusAuction.

Notification of Changes to the Privacy Policy

Our privacy policy is posted on the bottom of each page of CampusAuction. If at any point, there is a change to this Privacy Policy, including how We collect, use, or disclose Your personal information, We will notify You by e-mail to obtain Your consent. 

We will give notice of changes to the Privacy Policy not less than thirty days before the changes take effect.  You will be deemed to have been notified once We have sent the notice e-mail. 

Once you have received the notification, You have the option of either consenting to the modified privacy policy by continuing to use CampusAuction, or else opting out of the changes by terminating Your membership.  If You choose to terminate or cancel Your membership, You will, pursuant to the Agreement, forfeit any partiCApoints you may have collected as described therein.
